As tools like ChatGPT, Claude, Gemini, and open-source models become increasingly embedded in classrooms, they present profound opportunities for differentiated instruction, personalized learning, and administrative efficiency. However, without a coherent federal framework, the integration of generative AI in education risks inconsistency, inequity, and ethical vulnerability. The United States must move swiftly to establish a unified national policy addressing generative AI’s role in learning while providing educators and students with both the guardrails and guidance necessary to harness its potential responsibly. This report presents a comprehensive blueprint for developing such federal policy, incorporating legislative strategies, Department of Education actions, funding mechanisms, ethical frameworks, curricular integration, and approaches for fostering student literacy in generative AI.
Federal policy for generative AI in education should begin with an understanding that this technology, while emergent, will define the future of work and learning. AI models that generate text, code, music, and imagery are not limited to creative output; they can also adapt instruction, analyze student data for personalized feedback, and provide multilingual accessibility (Zawacki-Richter et al., 2023). Yet, alongside potential benefits come legitimate concerns about bias, misinformation, academic integrity, and data privacy. The goal of national policy must therefore be to balance innovation with accountability, promoting AI as a tool for human enhancement rather than substitution. The Office of Educational Technology (OET) within the U.S. Department of Education has already indicated that AI can “revolutionize education and support improved outcomes for learners,” provided that systems are implemented responsibly and equitably (U.S. Department of Education, 2023).
At the legislative level, Congress holds the power to set a national direction for AI in education. The bipartisan introduction of the National Science Foundation (NSF) AI Education Act of 2025 (H.R. 5351) demonstrates growing recognition that AI literacy is essential for workforce preparedness. This act proposes to expand NSF’s authority to fund AI education centers, research programs, and educator training, focusing particularly on underserved communities (U.S. House of Representatives, 2025). Federal legislation of this type can serve as the anchor for a broader policy agenda, integrating AI learning objectives into existing statutes such as the Elementary and Secondary Education Act (ESEA) and the Higher Education Act. For example, Title II of ESEA, which supports teacher quality initiatives, could be amended to explicitly fund AI literacy professional development, while Title IV could include provisions for purchasing AI-powered educational software that meets federally defined ethical and privacy standards.

The White House Task Force on AI Education, established in 2025, provides an interagency mechanism linking the Department of Education, NSF, the Department of Labor, and private-sector partners (White House, 2025). The Task Force’s charge includes creating public-private partnerships for AI education resources, developing AI literacy curricula, and administering the Presidential AI Challenge, a national competition rewarding innovative use of AI in teaching and learning. This structure should be expanded into a permanent National Council on AI in Education, with subcommittees addressing ethical standards, teacher preparation, and equity in access to AI technologies. Federal funding represents the practical foundation for implementation. The Department of Education’s recent clarification that formula funds may support AI is a crucial first step, but Congress should also establish new appropriations under NSF and the Institute of Education Sciences (IES) for large-scale research on generative AI’s impact on learning outcomes. NSF’s 2025 AI Education initiative, which funds research into K–12 AI curricula and teacher professional development, exemplifies how targeted investments can build capacity across the educational system (National Science Foundation, 2025). In 2025, major organizations committed substantial resources: Google pledged $150 million in AI education grants and free access to its Gemini platform for U.S. high schools, IBM promised to train two million learners through its SkillsBuild initiative, and Code.org launched a campaign to engage twenty-five million students in AI literacy (White House, 2025). AI vendors working with schools should be explicitly defined as “school officials” under FERPA, bound by the same confidentiality obligations as teachers. They must also provide clear data-retention policies, encryption standards, and deletion rights for parents and students. Federal contracts should prohibit the use of student data for commercial AI model training without informed, revocable consent. Policymakers might consider establishing a national “Education AI Trustmark” program that certifies products meeting federal privacy and fairness standards, much like the Department of Agriculture’s organic certification model.
